Terms of Service

These Terms of Service ("Terms") govern your use of the Choppkar loyalty platform ("Service"). By using Choppkar, you agree to these Terms.

1. Service Description

Choppkar is a multi-tenant loyalty platform that allows merchants to create digital stamp cards, bottle keep records, and voucher programmes for their customers.

2. Accounts

Customers: You access the Service by verifying your phone number via OTP. You are responsible for maintaining the security of your device and phone number.

Merchants: You create an account with email and password. You are responsible for keeping your login credentials and staff PINs confidential. You must not share your account with unauthorised parties.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to other accounts or systems
• Abuse the stamp or reward system (e.g. fraudulent stamp collection)
• Transmit malicious code, spam, or automated requests
• Circumvent rate limits or security measures
• Scrape, copy, or redistribute Service content without permission

4. Merchant Responsibilities

• You are responsible for honouring rewards and vouchers issued through your programme
• You must comply with all applicable Malaysian laws, including consumer protection and PDPA
• You must not use customer data collected through Choppkar for purposes beyond your loyalty programme without customer consent
• You are responsible for managing your staff access and PINs

5. Intellectual Property

The Choppkar name, logo, and platform design are our intellectual property. Merchant branding and content uploaded to the platform remain the property of the respective merchant.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or changes that temporarily affect availability. We will endeavour to provide notice for planned downtime.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. By using Choppkar, you consent to the data practices described therein.

8. Limitation of Liability

To the maximum extent permitted by Malaysian law:

• Choppkar is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the fees paid by you (if any) in the 12 months preceding the claim

9. Termination

• You may stop using the Service at any time
• We may suspend or terminate accounts that violate these Terms
• Upon termination, your data will be handled in accordance with our Privacy Policy

10. Governing Law

These Terms are governed by the laws of Malaysia. Any disputes shall be resolved in the courts of Malaysia.

11. Changes

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
